Terms of Service

1. Acceptance of Terms

Welcome to Menuvyn ("Menuvyn", "we", "our", or "us"), operated by Niamat Marjan. By creating an account, accessing, browsing, or utilizing our web applications, customer digital menus, kitchen display systems, API services, or mobile experiences (collectively, the "Service"), you confirm that you have read, understood, and agreed to be legally bound by these Terms of Service ("Terms") and our Privacy Policy.

If you are entering into these Terms on behalf of a company, restaurant, hotel, café, or other legal entity, you represent and warrant that you have the full legal authority to bind such entity. If you do not agree with any part of these Terms, you must immediately cease all access and use of the Service.

2. Description of the Platform

Menuvyn provides a modern restaurant technology suite that includes:

• Digital QR Menus: Mobile-first interactive dining catalogs, multi-language translation (English, Sinhala, Tamil), photo sliders (Easy Mode), modifier groups, and promotional flyers.
• Live Kitchen Cook Line & KDS: Real-time order dispatch, table-side group ordering tabs, line cook ticket management, and audio bell chimes.
• Diner Engagement & Marketing: VIP lead capture opt-ins, SMS notification alerts, and targeted broadcast messaging campaigns.
• Custom Branding & Domains: Curated typography studio, brand palette customization, and white-label custom domain mapping.

3. Account Registration & Security

To create a restaurant profile and publish menus, you must register for an account. You agree to provide true, accurate, current, and complete information during registration and to update such information to keep it accurate.

You are solely responsible for safeguarding the credentials you use to access the Service and for all activities that occur under your account. You agree to notify Menuvyn immediately at mniamatmarjan@gmail.com upon becoming aware of any security breach or unauthorized use of your account.

4. Subscription Plans, Billing & Renewals

Menuvyn offers both free and premium subscription tiers:

• Free Tier: Includes core digital menu creation, unlimited items, unlimited QR code scans, multi-language support, and customer contact capture.
• Pro Tier: Unlocks white-label custom domain mapping, branding watermark removal, full typography pairings, VIP customer leads export, and priority support.
• Business Tier: Includes all Pro features plus Live Kitchen Order Dispatch, Kitchen Display System (KDS), Staff Alerts (WhatsApp/Telegram/Email), and monthly SMS broadcast credits.

Paid subscriptions are billed in advance on a recurring monthly or annual basis. Unless canceled prior to the end of the current billing cycle via your Dashboard Billing settings, your subscription will automatically renew. All prices are stated in Sri Lankan Rupees (LKR) or United States Dollars (USD) and are exclusive of applicable local taxes unless explicitly stated.

5. Payment Gateways & Bank Transfer Slips

Payments for premium plans and SMS credit top-ups may be processed via:

• Online Payment Gateway: Secure hosted checkout supporting LankaQR, Visa, MasterCard, and local debit/credit cards. By paying online, you agree to comply with authorized payment processing terms and PCI-DSS compliance regulations.
• Direct Bank Deposit / Transfer: Restaurant merchants may deposit funds into our authorized corporate accounts and upload a legible bank deposit slip or transaction receipt. Manual deposits are subject to administrative verification and will be activated within 24 hours of confirmation.

6. Restaurant Merchant Obligations & Disclaimers

As a restaurant operator or merchant utilizing Menuvyn, you explicitly agree and warrant that:

• Food Safety & Allergens: You are solely responsible for food preparation, ingredient disclosures, hygiene standards, allergen warnings (nuts, gluten, dairy, shellfish, etc.), and compliance with all applicable health and food safety regulations.
• Pricing & Availability: All prices, taxes, service charges, and dish availability displayed on your menu are accurate and honor the amounts charged to dining customers.
• Licenses & Permits: You hold all valid statutory licenses required to operate your establishment, including public health inspector (PHI) clearances and liquor/alcohol retail permits.
• Customer Order Fulfillment: Menuvyn provides the technical software infrastructure for menu display and ticket transmission. We do not prepare, cook, deliver, or handle food. Any disputes regarding meal quality, delivery times, or order accuracy must be resolved directly between the restaurant and the customer.

7. Customer Leads & SMS Broadcast Rules

If you collect customer contact information (email or phone numbers) via Menuvyn's VIP Lead Capture or checkout flow, you agree to comply strictly with anti-spam laws, including obtaining explicit affirmative consent before sending promotional broadcast messages.

You agree never to send unsolicited spam, deceptive advertisements, offensive content, or messages outside standard business hours. Violation of SMS broadcast policies may result in immediate suspension of messaging credits and account termination without refund.

8. User Content & Intellectual Property

You retain full ownership of all text, images, logos, menus, pricing, and graphics you upload to Menuvyn ("User Content"). You grant Menuvyn a worldwide, royalty-free license to host, display, cache, and reproduce your User Content solely for the purpose of operating and delivering the Service.

All intellectual property rights in the Menuvyn platform, logos, algorithms, user interfaces, code, and documentation are and remain the exclusive property of Menuvyn and its licensors.

9. Account Suspension & Termination

We reserve the right to suspend or terminate your account and revoke access to the Service immediately, without prior notice or liability, if you breach these Terms, engage in fraudulent activity, violate applicable laws, or fail to settle outstanding subscription balances.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Menuvyn, its creators, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, goodwill, service interruptions, hardware failure, or food safety incidents arising out of or related to your use of the Service.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be instituted exclusively in the competent courts of Colombo, Sri Lanka.
